1. Use License

4. Content and Intellectual Property Rights

4.1 Our Content

All materials on the Service, including text, graphics, logos, images, audio, video, and software ("Content"), are owned by or licensed to Race Repeat and are protected by copyright and other intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited.

4.2 User-Generated Content

You retain full ownership of all content you upload, post, or submit to the Service (including photos, race reports, and comments). Race Repeat does not claim ownership of your user-generated content.

By uploading content to the Service, you grant Race Repeat a limited license to:

• Store and host your content within your personal account
• Display your content within your profile and personal galleries as you choose
• Use your content to provide and operate the Service

Race Repeat will not use your content for any purpose beyond the above without your explicit prior written consent. This includes, but is not limited to, marketing, promotional materials, publications, or sharing with third parties.

You represent and warrant that:

• You own or have necessary rights to the content you submit
• Your content does not violate any third-party rights
• Your content is not defamatory, obscene, or otherwise unlawful

4.3 Content Removal and Moderation

We reserve the right to remove any user-generated content at our sole discretion if it violates these Terms, applicable law, or our content policies. You may delete your content at any time through your account settings.

5. Payment and Subscriptions

5.1 Pricing and Fees

Subscription fees, if applicable, are displayed at the time of purchase and subject to change upon 30 days' notice. We reserve the right to modify pricing for future billing periods.

5.2 Payment Processing

Payments are processed through third-party payment processors. By providing payment information, you authorize the processor to charge your payment method for subscriptions and fees. You agree to keep your payment information current and accurate.

5.3 Billing Cycle and Cancellation

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of your current billing period. No refunds are provided for partial periods.

5.4 Refund Policy

Subscriptions are non-refundable. If you believe a charge was made in error, contact us within 30 days for review and potential adjustment.

6. Limitation of Liability

6.1 "As Is" Disclaimer

The Service is provided on an "as is" and "as available" basis without warranties of any kind. We disclaim all express and implied warranties, including fitness for a particular purpose, merchantability, and non-infringement.

6.2 No Guarantee of Availability

We do not warrant that the Service will be error-free, uninterrupted, or free from viruses or harmful components. We are not liable for any unavailability or downtime.

6.3 Liability Cap

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of revenue, profit, data, or business opportunity
• Damages arising from your use or inability to use the Service

Our total liability for all claims shall not exceed the amount paid by you in the past 12 months, or $100, whichever is less.

You agree to indemnify, defend, and hold harmless Race Repeat and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

The Service may contain links to third-party websites and services. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party services is governed by their terms and conditions, which you should review before use.

Third-party links do not constitute an endorsement or recommendation by Race Repeat.

9. Health and Safety Disclaimer

The Service provides training information and race tracking features for personal use. We are not medical professionals, and the Service does not provide medical advice. You acknowledge that:

• Running and endurance sports carry inherent risks of injury and health complications
• You assume all risks associated with participation in these activities
• You should consult healthcare professionals before beginning any training program
• Training data generated by the Service is for informational purposes only

Race Repeat is not liable for any injury or health issues arising from use of the Service or participation in running events.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

We may notify you of material changes via email or prominent notice on the Service.

11. Termination of Access

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for:

• Violation of these Terms
• Violation of applicable law or regulation
• Engaging in fraud or abuse
• Conduct harmful to other users or the Service

Upon termination, you lose the right to access the Service and user account data may be deleted.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any dispute, claim, or controversy arising from these Terms or the Service shall first be subject to informal resolution. You agree to contact us and attempt to resolve the matter within 30 days.

If informal resolution fails, both parties agree to submit to binding arbitration or litigation in the courts of England and Wales, as applicable by law.

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Race Repeat regarding the Service and supersede all prior negotiations, understandings, and agreements.

15. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated via email or prominent notice on the Service. Your continued use of the Service after such notification constitutes your acceptance of the revised Terms.

If you do not agree to the modified Terms, you must discontinue use of the Service.
